WAIVER

The participant (18+ years old) or the parent(s) and/or legal guardian(s) understand, acknowledge, and agree that:

1. “Martial Arts Activities” includes but is not limited to contact and non-contact martial arts activities, lessons, classes, training, use of facilities and services provided to the Student by the Organization, Rudy Rexx BJJ LLC.

2. There are inherent and significant dangers, hazards and risks associated with participation in Martial Arts Activities. I am aware that the Risks include but are not limited to injury from physical contact with other students, instructors or equipment, performing a skill incorrectly, or potentially dangerous obstacles, conditions or weapons on the floor or vicinity of the Martial Arts Activities. I acknowledge that injuries received may be compounded or increased by negligent rescue operations or procedures of the releasees.

3. I freely accept and fully assume all responsibility for all Risks and possibilities of personal injury, death, property damage or loss resulting from my participation in Martial Arts Activities at Rudy Rexx BJJ LLC. I freely assume responsibility for my own safety.

4. If at any time I feel anything to be unsafe I will immediately take all precautions to avoid the unsafe area and refuse to participate further. 

5. I acknowledge my obligation to inform the nearest employee of the Organization if I feel any pain, discomfort, fatigue or any other symptoms related to COVID virus (any variant) I may suffer before, during or immediately after my participation in Martial Arts Activities at Rudy Rexx BJJ LLC. 

6. There may be other risks not known to us that are not reasonably foreseeable at this time.

 7. I agree to be liable for and to hold harmless and indemnify Rudy Rexx BJJ LLC from all proceedings, claims, damages, cost demands including court costs and costs on a solicitor and own client basis, and any liabilities.

I hereby RELEASE, WAIVE, DISCHARGE, and COVENANT not to sue the martial arts facility used by the participant, including its owners, managers, and lessees of the premises used to conduct the martial arts event or program, directions, or instructions to engage in risk evaluation or loss control activities regarding the martial arts facility or events held at such facility and each of them, their directors, employees, all for the purposes herein referred to as “Releasee” FROM ALL LIABILITY TO THE UNDERSIGNED, my/our personal representatives, assigns, executors, heirs, and next to kin for any all all claims, demands, losses or damages and any claims or demands therefore on account of any injury, including but not limited to the death of the participant or damage to property, arising out of or relating to the event(s) caused or alleged to be caused in whole or in party by the negligence of the releasee or otherwise. 

EACH OF THE UNDERSIGNED further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the Province or State in which the event is conducted and that if any portion is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect.

On behalf of the participant and individually, the undersigned partner(s) and/or legal guardian(s) for the minor participant executes this Waiver and Release.  If, despite this release, the participant makes a claim against any of the Releasees, the parent(s) and/or legal guardian(s) will reimburse the Releasee for any money which they have paid to the participant, or on his behalf, and hold them harmless.

I hereby acknowledge and understand that Martial Arts are physical activities and learning self-defense skills involves some physical contact. Violet Crown (Rudy Rexx BJJ LLC) or its staff and students are not to be held liable or responsible for any risks and/or injuries as a result of training Martial Arts. The above person consents to the student participating in the classes/training and are aware of the risks involved in such use.

The people stated in this contract hereby hold Violet Crown (Rudy Rexx BJJ LLC), its successors, assigns, owners, officers, directors, employees, and agents harmless from all claims which may be brought against them by the people stated in this contract, student or on student's behalf for any such injuries or claims and do hereby forever release and discharge Violet Crown (Rudy Rexx BJJ LLC),  its successors, assigns, owners, officers, directors, employees, and agents from all claims, demands, injuries, damages, actions, losses and expenses.

I have read this release and waiver of liability, assumption of risk and indemnity agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and have signed it freely and voluntarily without any inducement, assurance, or guarantee being made to me and intend my signature to be complete and unconditional release of all liability to the greatest extent allowed by law.
